Terms of Service

1. Introduction

HistoOmics-AI is a research tool that infers gene expression profiles from histopathology images using artificial intelligence. These Terms of Service govern your use of the HistoOmics-AI web platform and associated services ("Service").

2. Research Use Only

HistoOmics-AI is for research use only. You may not use this Service for:

  • Clinical diagnosis or patient care
  • Commercial applications or profit-generating activities
  • Drug development or regulatory submissions
  • Any use that requires FDA approval or clinical validation

All results are for research purposes only and should not be used for clinical decision-making.

3. Academic Access

Access to HistoOmics-AI is restricted to academic and non-profit researchers. You represent and warrant that you are:

  • Affiliated with a university, research institute, or non-profit organization
  • Using a valid institutional email address or approved account
  • Using the Service for legitimate research purposes only

We reserve the right to verify institutional affiliation and suspend access if terms are violated.

4. De-identification and Data Responsibility

You are responsible for ensuring all uploaded images are properly de-identified.

  • You must remove all personally identifiable information (patient name, ID, MRN, dates) before upload
  • You must comply with HIPAA and your institution's IRB requirements
  • HistoOmics-AI does not independently verify de-identification
  • You assume full liability for any identifiable information you upload

5. Data Retention and Deletion

Data retention policy:

  • By default, your WSI files and results are retained for model improvement research; you can opt out on each submission
  • If you opt out of retention for a submission: all data for that submission (images, results) is automatically deleted 7 days after job completion
  • You may request manual deletion at any time by contacting our team
  • Deletion is permanent and cannot be reversed

6. Acceptable Use

You agree not to:

  • Upload identifiable patient data
  • Use the Service for commercial purposes
  • Attempt to reverse-engineer, decompile, or modify the model
  • Bypass rate limits (5 active jobs, 10 uploads/day)
  • Harass, abuse, or disrupt other users or the platform
  • Share your account credentials with others

7. Rate Limiting

To ensure fair access during the beta phase:

  • Maximum 5 concurrent jobs per user
  • Maximum 10 WSI uploads per day per user
  • Violations may result in temporary suspension

8. Disclaimer

HistoOmics-AI is provided "as-is" without warranties of any kind. To the extent permitted by law:

  • We make no warranty regarding accuracy, completeness, or fitness for any purpose
  • We are not liable for any direct, indirect, or consequential damages from use of this Service
  • The model is a research prototype and may contain errors
  • Results should always be validated by domain experts

9. Intellectual Property

Model: The underlying Path2Omics model is based on published research and available for academic use.

Your Data: You retain all rights to your uploaded images and results. By uploading, you grant us a non-exclusive license to use data for research purposes if you opt in to data retention.

Results: You may freely use analysis results from the Service for research publications and presentations.

10. Service Availability

HistoOmics-AI is provided on a best-effort basis during beta. We do not guarantee:

  • Uninterrupted availability
  • Specific performance or throughput
  • Data persistence beyond the stated retention period

We may modify or discontinue the Service with reasonable notice.

11. Termination

We reserve the right to suspend or terminate your access if you violate these terms, misuse the Service, or fail to maintain valid institutional affiliation.

12. Governing Law

These Terms are governed by the laws of California. Any disputes shall be resolved in state or federal courts located in Los Angeles County.
